Please read these Terms of Service carefully before accessing or using our site. By accessing or using any part of it, you agree to be bound by these Terms.
1. General Conditions
1.1 Acceptance of Terms. By visiting our site, or purchasing from us, you engage with our "Service" and agree to be bound by these Terms of Service ("Terms").
1.2 Age of Majority. By agreeing to these Terms, you confirm that you have reached the age of majority in your state or province of residence.
1.3 Right to Refuse Service. We reserve the right to refuse service to anyone, for any reason, at any time.
2. Online Store Terms
2.1 Products and Services. Certain pieces may be available exclusively online, at limited quantities, and are subject to return or exchange only in accordance with our separate Returns and Refund Policy.
2.2 Accuracy of Billing and Account Information. You agree to provide current, complete, and accurate information for every purchase made through our store, and to promptly update your account details — including email address and payment information — so we can complete your transactions and reach you as needed.
2.3 Product Accuracy. We take great care to represent our pieces faithfully, particularly the color and quality of gemstones and metal finishes. That said, we cannot guarantee that any monitor will render color or texture with complete accuracy. Natural gemstones may vary slightly in color, size, and inclusion pattern from piece to piece — a reflection of their individual character rather than a flaw.
3. Order, Payment, and Pricing
3.1 Order Acceptance. Your order confirmation email is an acknowledgment that we have received your order, not our acceptance of it. Acceptance is complete only once the goods are dispatched. We reserve the right to refuse or cancel any order for any reason, including limited availability, inaccuracies in product or pricing information, or concerns identified by our fraud prevention team.
3.2 Pricing and Modifications. Prices are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to update information or cancel orders where information on the Service is inaccurate — including after an order has been submitted.
3.3 Payment Security. We do not store your card details. All transactions are processed through secure, encrypted third-party payment gateways, including Shopify Payments and PayPal.
4. Shipping and Delivery
4.1 Shipping Policy. Shipping rates and estimated delivery times are detailed in our separate Shipping Policy. You are responsible for providing an accurate shipping address.
4.2 Risk of Loss. Risk of loss and title for all products pass to you once we deliver them to the carrier. We are not responsible for packages lost or stolen after the carrier confirms delivery.
5. Intellectual Property and Copyright
5.1 Ownership. All content on this site — including images, text, logos, product designs, and the Elegance Avenue name — is the intellectual property of Elegance Avenue, or is licensed to us, and is protected under applicable copyright and trademark law.
5.2 Use Restrictions. You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of the Service, or access to it, without our express written permission.
6. Disclaimer of Warranties; Limitation of Liability
6.1 Limitation of Liability. Elegance Avenue, along with its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors, will not be liable for any injury, loss, or claim, nor for any direct, indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, lost savings, or loss of data — arising from your use of the Service or any products obtained through it, whether based in contract, tort (including negligence), strict liability, or otherwise.
7. Governing Law and Dispute Resolution
7.1 Governing Law. These Terms, and any separate agreements under which we provide you Services, are governed by and construed in accordance with the laws of India.
7.2 Dispute Resolution. Any dispute relating to these Terms is subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
